Six Figure Settlement For Car Wreck
Late one evening as our client was driving home, she was rear ended by a drunk driver. Both parties were transported to the hospital for injuries. The drunk driver later fled the scene at the hospital. Due to the facts of the case and the extent of our client’s injuries, we secured a six-figure settlement in the case.
College Athlete Arrested
RESULT: Through negotiations with the college, our firm was able to successfully keep our client enrolled and reputation intact.
After being arrested, a college athlete was facing expulsion from college due to alleged violations of the student code of conduct. Prior to the administrative hearing with the college, our firm successfully argued for the student’s criminal charges to be dismissed. Despite this, the hurdle with the college remained because college administrators may still find a student in violation of the code of conduct even if that student is not found guilty in criminal court. The reason for this is because student conduct hearings have a much lower standard of proof to find the student in violation in comparison to criminal cases. The student-athlete faced severe sanctions from the athletic department as well. Through negotiations with the college, our firm was able to successfully keep our client enrolled and reputation intact.
DUI 2nd Charge
RESULT: Charges Dismissed
Our client was arrested for DUI 2nd offense, which carries a mandatory minimum prison sentence, due to the client’s prior conviction for DUI. The client’s blood alcohol concentration (BAC) level was high. However, through extensive research and negotiations, we successfully secured a plea agreement to reckless driving and avoided a DUI conviction completely. This was due to a number of factors, such as the client’s prior DUI being from several years ago as opposed to a recent conviction, thoroughly investigating and pointing out the errors in the traffic stop, and challenging the officer’s failure to comply with all of the breath site procedures.
Felony DUI
RESULT: Charges Dismissed
Client was arrested for Felony DUI based on great bodily injury. We presented effective legal arguments challenging the collection of the evidence as well as the blood results. Our client had no prior criminal history and was not found to be driving at the time of the incident. Based on our successful arguments and our client’s lack of record, we were able to have the Felony DUI charge dismissed.
Discreetly Prevented High Profile Client From Being Charged With Sexual Misconduct
RESULT: No Charges Filed
A high profile client was accused of sexual misconduct but had not been charged with any crime yet. Our client had no history of this type of conduct and, from day one, denied the allegations. The client’s reputation and family were on the line so we had to act fast, discreetly and vigorously to get to the bottom of the allegations. During the pre-charge phase of the criminal accusation, we used our experience and resources to independently collect evidence in our client’s defense to present to the detectives. Our firm found evidence that the accuser was not being truthful in the recollection of the events. Ultimately, we successfully argued for detectives to close out the investigation without charging our client with a crime.
Domestic Violence 2nd Charge Referred to Pre-Trial Intervention
RESULT: Charges dismissed upon successful completion of pre-trial intervention program.
The client was accused of threatening and/or pushing his spouse while in front of their minor child. Our client had recently received a several million dollar settlement and, at the time of the arrest, our client’s spouse had just filed for divorce and was seeking primary custody of the minor child as well as alimony. In other words, we were able to demonstrate the primary motivator in this case was money and that the facts of the case were not particularly strong. After extensive discussions, we secured the pre-trial intervention program for our client, which meant the charge would be dismissed upon the successful completion of the program.
Military College Student Falsely Accused of a Crime
RESULT: No Charged Filed
The allegation was that the military student engaged in sexual relations with another person who, at some point, did not want to participate anymore. There were no allegations of force nor any allegations of alcohol or drugs by either party and the accuser changed the story multiple times throughout our representation. Through extensive research, meetings, legal arguments and evidence collection proving our client’s innocence, we successfully had the case closed without charges being filed.
Domestic Violence of a High and Aggravated Nature (DVHAN) and Burglary First Degree
RESULT: Successfully negotiated a plea to a short term of probation, keeping our client from serving any time in prison.
Our client was in a periodic romantic relationship with the alleged victim when he showed up unannounced at her home after a night of drinking. The alleged victim was with another male and the situation became heated quickly. With video evidence and a confession, our client was facing up to a life sentence in prison. Our firm quickly got to work and successfully negotiated a plea to a short term of probation, keeping our client from serving any time in prison.
Client Charged With Felony DUI With Death Released After A Few Months In Jail
RESULT: Client avoided a lengthy prison sentence and was able to quickly return to her family.
Our client was charged with Felony DUI where the victim was killed as a result. The client was facing a mandatory minimum of one year to twenty five years in prison. The evidence was overwhelming in this case so we quickly worked to develop a mitigation plan. Upon making bond, we agreed to our client wearing an ankle monitor. Our client proactively sought counseling and life improvements during this time as well. During sentencing, our firm presented the court with a large mitigation packet. Additionally, the court agreed with our legal argument that time on the ankle monitor counted toward the sentence because it resembled incarceration. As a result, our remorseful client avoided a lengthy prison sentence and was able to quickly return to her family.
Medical Student Facing Expulsion For Harassment
RESULT: Prevented our client from being charged criminally as well as avoid being expelled from the medical college.
Our client was in the last year of medical school when someone accused our client of harassment. The client was accused of sending Tik Tok and text messages of a harassing nature to the accuser. The accuser was also in medical school at the time and filed the complaint with the university. Through our experience handling college and post-graduate cases, we were able to prevent our client from being charged criminally as well as avoid being expelled from the medical college.
